The Board of Zoning Appeals (BZA) is responsible for deciding whether
variances from the Town's zoning regulations can be granted based upon
special physical conditions of property, administrative appeals of the Zoning Ordinance, or interpretations of the Zoning Map where there is uncertainty as to the
location of a zoning district boundary.
Following the public hearing,
the Board of Zoning Appeals makes a final decision. If someone does not agree with the decision of the BZA, they can file a petition
with the Circuit Court to review the decision of the BZA.
The five members of the Board are appointed by the Circuit Court Judge
upon recommendation from the Town Council. All members are appointed
at large and do not represent any particular magisterial district.
